Linden dropped from Mims lawsuit

LINDEN — Members of the city council received notice Tuesday afternoon that Chilton County Commissioner Tim Mims dropped the city from a lawsuit he filed after a 2009 incident.
The news came just over a year after Mims was arrested on the charge of third degree assault during a high school football game between Maplesville and the host Linden Patriots.
“A big relief,” Linden Mayor Mitzi Gates said of the news. “I never really understood why the City of Linden was implicated. I think our officers assisted any officers would.”
Marengo County District Court found Mims not guilty of the charges Dec. 1, 2009. Mims reportedly filed the suit seeking punitive and compensatory damages from the City of Linden and a number of individuals, including his arresting officers.
Despite the City of Linden’s dismissal from the suit, the case reportedly still stands against a number of individuals involved in the arrest.
